Enduring Power of Attorney UK EPA
A "power of attorney" (UK) is a legal process to enable other people to be able to deal with your
affairs on your behalf e.g sign cheques, pay bills etc.
An enduring power of attorney differs in that it can continue to be used (provided it is
registered by the attorney) even if you become mentally incapable of managing your own affairs or understanding who
is acting on your behalf. It is therefore a good idea to create an enduring power of attorney (EPA) rather than a
simple power of attorney as it can be used in exactly the same way and has the added benefit of being useable
should you lose your mental capacity for whatever reason.
You MUST be mentally capable and understand what you are doing at the time of making an EPA.
Should you make an Enduring Power of
Attorney?
In our opinion everyone should have an EPA, even if it is not needed immediately. You can create an EPA and
simply choose to leave it with your Will, or in another safe place, so that it is always available should it be
required at a later date. It can only be used if the original is given to the attorney, who would then have to
produce it to others to prove that they are actually authorised to act on your behalf. The attorney will be aware
of its existence as they have to sign the EPA too, and you will need to make them aware of where the original is
going to be kept, so that they can use it if needs be.
You can make an Enduring Power of Attorney Online in minutes for just £27.95. The new Lasting Power of Attorney
could cost up to £1,000. For further information click here
What is the Best Way to Make an Enduring Power
of Attorney in the UK?
Although a legal document, making an EPA is relatively straightforward and in the vast majority of cases does
not require the services of a solicitor. The easiest, quickest, and certainly cheapest, way is to make an enduring
power of attorney online.
There are many websites where you can make an EPA in Minutes. We have looked at many and, in our
opinion, the best is available here.

Important Note: The cut-off to make an EPA was the 1st October 2007. EPAs are
now no longer available. EPAs made prior to midnight on the 30th September 2007 continue to be
valid
